    Atkins pointed out that merely four crypto issuers have ventured through the SEC’s complete registration process, known as “Regulation A.” This statistic reflects the mismatch between traditional regulatory frameworks and modern financial needs. To resolve this, Atkins called for the creation of clear regulatory pathways, including exemptions and safe harbors, to facilitate efficient token offerings without the cumbersome burden of unnecessary details.

    Reevaluating Custody Regulations

    Recent developments have seen the SEC withdraw Staff Accounting Bulletin No. 121, a move welcomed by firms eager to manage digital assets. Atkins sees this as the beginning of a larger overhaul regarding who can qualify as a “custodian” for digital assets. Acknowledging the innovative self-custody solutions some funds and advisors employ, Atkins advocated for a flexible approach that balances security with the burgeoning nature of digital asset management. Currently, the market is limited to two “special purpose broker-dealers,” but Atkins hinted at a more pragmatic regulatory framework on the horizon.

    Innovative Trading Platforms in Focus

    A central issue discussed by Atkins was the need for advanced trading platforms, or “super apps,” that integrate a variety of financial products, including stocks and cryptocurrencies. Present laws do not prevent broker-dealers from listing both securities and non-security tokens, opening the door for a comprehensive trading ecosystem. The SEC staff has been tasked with revising rules for alternative trading systems and considering whether national exchanges could soon list tokens, potentially broadening investor access and choice.

    A newly established Crypto Task Force, led by two SEC commissioners, exemplifies the agency’s commitment to cohesive regulatory strategies. This task force is designed to dissolve the silos that have historically impeded progress by amalgamating policy, legal, and technical expertise.
